Councillor for New Technologies and Speaker of the Local Government of the City of Molina de Segura, Victoria Gomez Alcazar, reported in a press conference today, Thursday 27 November, on the ruling of the Superior Court of Justice in the Region Murcia, which agrees with the City Council in the matter of the request for compensation for the disconnection of a mobile phone antenna.

El Ayuntamiento de Molina de Segura carried out the disconnection of a mobile phone mast in Cartagena Street (Barrio del Sagrado Corazón) for lack of building permit from the February 27, 2001 to July 3, 2002.
The operator filed an appeal against administrative decisions, handed down a ruling declaring that the license applied was consistent with urban planning, why should be granted.
Subsequently, the operator initiated claim claim for damages, amounting to 171,234.90 euros, by the time the antenna was off.
The Court of Administrative Number 2 in Murcia allowed the appeal condemning the City to pay that amount.
The Supreme Court ruling reverses that decision, granting the right to City Hall.
Recently, the full City Council of Molina de Segura has passed two ordinances relating to mobile telephony, the order of installation and operation of radio infrastructure, and fiscal ordinance regulating the occupancy rate of the subsoil, soil and space for local public companies providing mobile telephone services.
Through these ordinances, the City seeks to regulate an activity that until now lacked legal regulation.
Both ordinances are currently under appeal in court by several operators.
