Justice gives reason to neighbors Altorreal and responsibilities required PSOE Contreras (26/03/2015)

The PSOE candidate for Mayor of Molina de Segura, Esther Clavero, responsibilities requires the government team of PP, with Eduardo Contreras at the head, after the court judgment annulling the agreement of the Local Government Board on 29 March 2011 which granted permission for the construction of a service station in Altorreal urbanization.

Clavero says the mayor "has suffered a big blow to justice" and recalled that the PSOE was adamantly opposed at the time, with several motions in 2010 and 2011, the installation of the gas station in Altorreal past the houses.

Furthermore, criticizes Clavero Contreras reports of the general secretariat and a municipal architect clung to reject the request to suspend the license.

The ruling held that "the administrative act of station license grant was issued based on an illegal urban setting, should therefore be annulled."

In a letter dated March 11 ruling, Judge José Miñarro considers the appeal of the conservation entity Altorreal against the City and commercial Disa Peninsula which owns the petrol station and Laborda Properties which owns the field level, which may lodge an appeal because the judgment is not final.

Clavero indicates that the PSOE always said that the license granted to the previous owner of the land, Urbis SA, took on a plot of EP2 type, corresponding to social and private equipment, which prevented the construction of a gas station, according to ordinance.

Urbis acknowledged owning qualified as EP2 ground, as so designated by the judge who also notes that "was resolved the complaint alleged permanently by agreement of the Governing Council of 26 September 2003, by which it was established that the plot litigation is EP2 ".

The judgment communes with the approach of the urban entity, such platform 'No to the gas station Altorreal' and PSOE, who insisted that the General Plan de Molina was approved in 2006 and the agreement of the Council of Regional Government, dated three years earlier, was not appealed "never" by the owner of the land or by the city, so it must be from the same when determining the urban classification of the land on which it has built a shopping center and station.

In fact, the judge states that "no doubt" that the plot was legally qualified as EP2, adding that the City Magistrate granted planning permission on January 9, 2007 for the construction of that center.
